Eley Affiliate Terms and Policies

Thank you for considering the ELEY Affiliate Program. These policies outline the nature of the relationship between you, Eley Corporation and the referred customers. Please read through these policies in their entirety. If you have any questions, please email us at [email protected].

Terms
This agreement describes the terms and conditions for participation in the ELEY Affiliate Program. In this agreement, the term “Affiliate” refers to you (the applicant), and the term “Eley” refers to Eley Corporation, a Nebraska Corporation, with whom you are entering this agreement. By applying to the Eley affiliate program, you are confirming that you have read this agreement and agree to the terms and conditions.

Sample Products
Eley does not provide one-time discounted product samples to new affiliates for “testing, approving and showcasing,” in return for potential traffic and conversions. However, if you believe your existing online traffic merits an exception to this policy, and can back it up with current and verifiable data, you can submit such a request and supporting data to [email protected].

Commissions
For a transaction to generate a commission to an Affiliate, the referred prospect must submit an online order on www.eleyhosereels.com and remit full payment for the items ordered. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard. Commission cookies are set at 30 days.

Payment
An Affiliate can request payment when their balance reaches a minimum balance of USD 25.00. Payments can be requested every 30 days. Payments will generally be paid out via PayPal.

Refunds
In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.

Usage and Obligations
Affiliates are permitted to use the Eley Hose Reels brand and marketing resources available in the Eley Affiliates Creative section. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials.

The Affiliate will never imply that they are acting on behalf of Eley and will never advertise Eley products directly. The Affiliate will never bid for advertisements that compete with Eley.

The Affiliate will never represent themselves, Eley or their relationship with Eley falsely or misleadingly.

The Affiliate will not engage in the distribution of unsolicited bulk email (spam) mentioning or referencing Eley.

Term and Termination
Either party has the right to terminate the agreement immediately without prior notice. If the Affiliate terminates the agreement, no further commissions from Eley will be paid for any past or future customer transactions. If Eley chooses to terminate the agreement, any unpaid balances will be paid to the affiliate within 45 days of termination.

Governing Law
This Agreement shall be governed, construed, and enforced by the laws of the State of Nebraska, without regard to its conflict of laws rules.

Arbitration
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the State of Nebraska. An award of arbitration may be confirmed in a court of competent jurisdiction.

Modification
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but are not limited to, changes in the scope of available commissions, commission schedules, payment procedures, and Affiliate Program rules.

SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you provide, such as your name, address, email address, and payment information.

When you browse our store, we also automatically receive certain information about your device, including your Internet Protocol (IP) address, browser type, and operating system. This information helps us understand how visitors use our website and improve your experience.

Email and SMS Marketing

The right to request deletion of your personal information

The right to request correction of inaccurate personal information

The right to limit the use of certain sensitive personal information (where applicable)

We do not sell personal information for monetary compensation. However, certain data sharing practices (such as analytics or affiliate tracking) may be considered “sharing” under California law.

SECTION 4  – DISCLOSURE

We may disclose your personal information if required by law or if you violate our Terms of Service.

SECTION 5  – SHOPIFY

Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products and services.

Your data is stored through Shopify’s data storage systems, databases, and the general Shopify application. Shopify stores your data on secure servers protected by firewalls.

Payment

If you choose a direct payment gateway to complete your purchase, Shopify stores your credit card data. It is encrypted in accordance with the Payment Card Industry Data Security Standard (PCI-DSS).

Your purchase transaction data is stored only as long as necessary to complete your transaction, generally for up to 30 days. After that, your transaction information is deleted in accordance with applicable standards.

All direct payment gateways adhere to the standards set by PCI-DSS, as managed by the PCI Security Standards Council, a joint effort of major payment brands including Visa, MasterCard, American Express, and Discover.

PCI-DSS requirements are designed to ensure the secure handling of credit card information by our store and its service providers.

SECTION 6  – THIRD-PARTY SERVICES

We use third-party service providers including e-commerce platforms, analytics providers, marketing tools, fulfillment partners, customer support tools, and affiliate tracking platforms to operate our business.

In general, these providers will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain providers, such as payment gateways and other payment transaction processors, have their own privacy policies governing the information we must provide to them.

For these providers, we recommend that you review their privacy policies so you can understand how your personal information will be handled.

Certain providers may be located in jurisdictions different from your own. If you choose to proceed with a transaction involving a third-party provider, your information may become subject to the laws of those jurisdictions.

Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Service.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with third parties for their own marketing purposes, but may be processed by service providers solely to deliver messaging services on our behalf.

While we take commercially reasonable steps to safeguard your information, no method of transmission over the Internet or electronic storage can be guaranteed to be 100% secure.

SECTION 8 - DATA RETENTION

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
